Are Rohnert Park's Government Officials Acting Like Las Vegas Mobsters?

An accusation by the coalition against the construction of a Rohnert Park casino likens RP city officials to Las Vegas mobsters. Do you agree?

The big news around Rohnert Park these days is the coming of a casino that's said to bring millions of dollars of revenue for the city and schools in Rohnert Park.

But now an allegation has sprung up that the agreement -- a memorandum of understanding that addresses the impacts of the casino on the city --  between Federation Indian of Graton Rancheria (FIGR) and the city is invalid.

Stop the Casino 101 Coalition said that all construction needs to be stopped and they have filed a court complaint alleging that the gambling compact awarded to the tribe behind the casino is invalid because it is contingent on an agreement that doesn't exist between the city and the tribe.

According to this story in the Press Democrat, the tribe originally had planned the construction of the casino on lands that overlap with the current 254-acre Wilfred Avenue reservation. But the actual location of where construction recently began is not where they tribe stipulated it would be in an existing agreement with the city.

The group that's against the casino said because the location is off, the MOU is invalid and the construction is being done illegally.

In the Press Democrat's story, city officials said are planning to address this issue, at a future time. However, Stop the Casino 101 Coalition is demanding an injunction against the construction of the casino until the matter can be sorted out.

According to a Stop the Casino 101 press release:

The issue of the invalid MOU was raised in the Second Amended Complaint in Stop the Casino 101 Coalition v. Governor Jerry Brown that was filed July 31.  Attorney for the Plaintiffs Michael Healy sent a letter and a copy of the Press Democrat article to Deputy Attorney General Bill Williams today advising them of this admission by the City.

In his letter, Mr., Healy says, "The lack of an effective MOU between the City of Rohnert Park also means that the Compact is not yet in effect and that the current construction activity is illegal. Please advise at your earliest opportunity what steps your client intends to take to halt this illegal activity, so as to avoid the necessity of further law and motion practice.""

"We are calling upon the Governor's office to do what they are required to do, and shut down casino construction now, " said Pastor Chip Worthington, founder of Stop the Casino 101 Coalition (STC101), one of the Plaintiffs in a lawsuit challenging the state gambling compact passed in May. "No agreement means no compact means no casino."

"The City knew they had no agreement, the FIGR knew they had no agreement and the Governor's office knew there was no agreement, but they let the compact go forward anyway, and just hoped no one would notice," he said. "Well, we noticed."

"This is unconscionable behavior. The future of our community is at risk, and our government officials are acting like Las Vegas mobsters. From top to bottom, this is a betrayal of the voters' trust."

STC101 has already requested an injunction to stop casino construction in its Second Amended Complaint, but a date for the hearing has not yet been set.

The casino is coming.. You may not like it but it is coming.. At some point you need to realize that and stop slowing the process down.. It still going to be built

That's okay, delays are annoying and we will have to pay the price for years, so I say annoy the crooked ones a little bit. The way this has been handled just smacks of corruption, not even being put to a vote by the people of our town, and that's Indian reservation land like I'm a monkey's uncle. I've lived here since 1976 and never heard anything about an Indian reservation in Rohnert Park, we were all fed manure on this one.

The same people whining about the casino are the same ones who used to advocate the rights of Native Americans. Now that the Indians want to build a casino in our town, they've singing a totally different tune.
You can't say the Indians have every right to do what they want with their land and then complain when they do it. IM sure a lot of people (including me) would enjoy the prospect of a job opportunity and the city could certainly use the revenue. Every day we watch as tons of $$$ drives right thru RP on it's way to River Rock. What's wrong with enticing that $$$ to be spent here instead?

I can assure you that if you built part of your million dollar home on property that wasn't included in your approved construction plan, you would have an injunction to stop construction immediately. To use the argument that it is just a few feet over the line should not hold water.

Well then Jean let me educate you. This whole valley is Native American land! My family have been here for centuries. You see the European folks came in and ripped the Native populations of their lands a long time before you or your grandparents were even a thought. There were treaties signed by the US government and then broken by that same government. I am not going to go into the specifics of those treaties at this time. The Native American tribes who became federally recognized, sovereign nations, are now taking back some of their own lands so they have places to build housing, live and work. Your statement about being fed manure is accurate as you are the one spreading it! Please do your DD before making a silly statement like the above.

#1, let us get this out of our mind that this is an Indian project. This is big Las Vegas folks, who dearly want to get just one of thier mega casinos near San Francisco. Up to now the casinos have been small time operations and card rooms. Picture the neon blasting Caesers Palace right on highway 101. Also, if you read the PD article today, the junk bond financing for the casino is very shaky to start with and it might very well fall apart.
Futhermore, as this gets closer, residents will realise what a #2, It is important to delay the project as much as possible in the hopes that some sensible political leaders come to the forefront and stop this environmental disaster from ruining our treasured Sonoma County. No, the RP City Council are not mobsters. But several are looking ahead to thier own self interestes when the Casino begins to run this town. Robert Aherne

Robert, The Graton Tribe does not need anybody's permission to go ahead and build their casino on their land! They, I am sure, would rather have the input from the community as they really do want a favorable community. However if they choose to move ahead, it can be with or without an politicians approval; it does not make any difference! The current delay (if any) is just temporary at best. One needs to understand Tribal Sovereignty and exactly what a separate nation means.You Robert know absolutely nothing about Indian Gaming at all. This is 100% an Indian Project. Station is the vendor the tribe is using to deploy the casino. As far as Las Vegas "dearly wanting to get one of their casino's in the bay area" This too is hogwash Las Vegas has been loosing customers to the gaming venues that already exist no just in the bay area but the who state and country! Again, one needs to get the DD done before one open's one's mouth.

The RP tribal casino is inevitable with the signing of the tribal/state compact. All the minor delays is only money in the pockets of attorneys. Yes, the casino will create hundreds of temporary construction jobs, but my concern is for more LOCAL long term jobs. All California tribal casinos that have opened in the past have promised thousands of jobs, but how many have actually gone to the local community/state residence? There must be a commitment from the Graton Rancheria and Station Casinos to hire the majority of front line casino employees and middle management from the Bay Area and California state residence workers first. There are enough Northern California local residences that have casino/resort experience that Graton/Station have no justifiable reason not to place a commitment of their promised 2500 casino jobs go to the local Bay Area market applicants and not to out of state/non-local applicants.

Hurray for the Stop the Casino 101 people! Let's recall some information we're being fed: the leader of the tribe is someone who based his tribal statys on rumor (I don't recall reading about a DNA test to prove his origins), when the tribe asked for status they said they would not build a casino, and now they are changing which land they will use. Do you really think they are going to give RP the money they promised, let alone hire locally?

Once the casino opens and the degenerates flock in to Rohnert Park, you will be singing a different tune. It happened at South Lake Tahoe in the 60's and they are just now beginning a long recovery process. Wait and see.

WE'RE RIGHT ON TARGET: Some people think that we filed our lawsuit too late,, but that's not the case. The way the law works, with rare exception, is that something actually has to happen to you before you can go to court. The Compact actually had to be signed and approved before we could challenge it. The casino actually had to become something more than "theoretical", as the federal court reminded us in 2008. The court said then that the casino was "theoretical", so our lawsuit was premature, and to come back when the injury had actually occured. And that's precisely what what we're doing. So to some, it may seem as if we're "late", but from a legal standpoint, we're right on target.

We assert that the Governor cannot enter into a compact with Graton because the land is still under the state's sovereign control and state jurisdiction, and is subject to state law. Casino gambling is not allowed on state land in California. Please read our current Complaint that was filed in State Superior Court challenging the compact. They absolutely do need permission. Trbal casinos are regulated at the state level. The state must decide whether or not to allow them, it must provide a gambling compact, and it has all the oversight duties. But more importantly, because the State has never ceded its sovereignty over the casino site land to the federal government, as required by state and federal law, the land in question is still state land and not under federal jurisdiction, but state jurisdiction, and casino gambling on the site is illegal under state law. In addition, a VALID agreement with Rohnert Park must be in place before construction can begin. That's what Greg Sarris agreed to when he signed the gambling compact with the governor. It took him less than a month to break his word. .Please read our lawsuit and my comments elsewhere on this page.. But Don, the Supreme Court said in 2005 that the Doctrine of Laches applies to Indian land claims. That means if they wait too long to make their claim, they have lost the right to make that claim. Generally, 200 years or so is conisdered far too long.

The 2003 MOU only applied to the parcel numbers included in the MOU. Even the federal government that regulates tribal casinos said (several times) that the 2003 MOU does not apply to the new site, which was purchased in 2005. The new site does not include many parcels that were in the 2003 MOU and does include parcels numbers that were not in the MOU. The casino's state gambling compact, without which Graton Rancheria cannot conduct gambling, includes only the parcels purchased in 2005. The compact says that an agreement with Rohnert Park MUST be in place before construction can begin. Graton Rancheria has violated the compact, and the construction is illegal. The Governor has a duty to the people of California to stop this illegal construction. Without an agreement, Rohnert Park is not protected against any impacts, and it can get no money from the casino

An MOU is not iron clad. The two parties can modify it at any time. In other words it is a "Gentlemen's Agreement" reduced to writing. Stop Casino 101 does not have a dog in this fight.

I'm wondering if a judge or the governor will really stop this thing, given an MOU isn't usually considered contractual. If it does, the Rancheria and the City have the worst attorneys, ever, for overlooking this and should sue to get their fees back. Then again, perhaps the attorneys simply felt the MOU wasn't legally binding and the compacts between the State and Graton and the Feds and Graton would be sufficiently legally binding to obviate the MOU, including the parcels in question. The goal here seems to be to further delay the process that is inevitable. Worst case the City will in all probability simply draft a new MOU including ALL the parcels and send it on its way through the process again with the State and Federal governments, if it even has to do that. Of course that could delay it, probably for another couple of years, which I suppose is the point. At the end of the day, though, the casino gets built and in the meantime millions of dollars have been wasted in legal fees as the process resets and winds its way through the bureaucracy yet again. Though I'm completely against the casino and think it's a terrible idea - I live literally around the corner from where it's going to be built - and I applaud the efforts of the coalition and city leaders who are justifiably against something that facilitates and enables very bad behavior and consequently often very bad people, it's probably going to be throwing good money after bad.

Readers should be aware that all of the legal efforts to stop the casino over the past years have been mounted and paid for by local residents, myself included. Several lawyers have done extensive pro bono work in filing our petitions. We got absolutly zero help from anyone else. Mike Healy of Petaluma has put in many hundreds of hours of very smart legal work to help us petition for our rights against very wealthy Las Vegas interests, not to mention the self serving politicians who are jamming this down our throats in Sacramento and Washington DC.
Now some of you may think this project is payback for past sins and that is understanable - except it is not. This whole thing is about very questionable money flowing into the pockets of Station Casinos of Las Vegas, the junk bond financers, the Sacramento politicians who force this on us and the likes of lobbists like Doug Boxer. It's not surprising that the usual NIMBY's bring up the same arguments they did when River Rock was opening. They said it would be an eyesore. It isn't. They said it would attract the dregs of society. It doesn't. They said the crime rate would skyrocket. It hasn't. They said when thewgot their liquor license there would be convoys of drunk drivers as a result. There wasn't. One person here is concerned about the lights of Ceasar's Palace polluting the town. Sure, just like that ridiculous lighted Spreckels sign. It slowed traffic for a while now it's mostly ignored.
The pros of this attraction far outweigh the negatives.

Lake Tahoe isn't recovering. Lake Tahoe has had a major job loss and has been in a major business recession for the past decade. The Casino industry since the 60's built up a local small business infrastructure that was supported by the growth of its tourism industry and local job opportunities. Due to legal tribal gaming since 2000 in California, Lake Tahoe has lost hundreds of small businesses and thousands of local jobs. The all year round population of Tahoe has decreased by more than 30% in the past decade due to the loss of local jobs and 60% of the homes are vacant or used as rental property due to those lost jobs. What recovery??

The stop the casino gang is sure making their lawyers wealthy! more then they already are that is. They must like peeing into the wind because they sure do lots of it. The land IS in Federal Trust to the tribe. period! There is nothing that will change that. The compact between the state and the tribe is done. Get used to it! stop whining and start doing something constructive.

I agree with Robert Aherne's comment from last week. Las Vegas backed $$ saw the writing on the wall back in the late 80's when Ronald Reagan created the loophole in the law for 'gifted land' to be declared soviern territory. Now we have postage stamp areas of our state (and nationwide) that do not abide by local or state laws banning casions. Las Vegas is loosing market share with the poor economy, and this is taking candy from a baby for them. Now folks won't have to incur the cost of airfare to Vegas - it will be popping up all around us, and the communities are ham-strung. No politician I see anywhere, including our Governor is brave enough to risk the loss of a re-election by simply saying No More. Really sad. The loopholes in the federal law need to be closed. I am all for Native peoples thriving, and living a powerful life in all of America - are Casino's the only way they can achieve this???

Rohnert Park City Manager Gabe Gonzalez has written a letter to the Rohnert Park Patch editor, complaining about the headline, "Are Rohnert Park's Government Officials Acting Like Las Vegas Mobsters?" The Patch has not (yet) published this letter.
In the letter, Gonzalez states that he finds the headline to be "offensive and terribly insulting to the the hardworking elected and appointed officials...of Rohnert Park." Mr. Gonzalez, you were appointed to a public position by a board of elected representatives. Part of your JOB is to undergo public scrutiny, It was the Stop The Casino 101 Coalition that made that statement; the Rohnert Park Patch published it, clearly identified as such a statement, as a legitimate news item. ANY effort to squelch public discussion of news amounts to an attempt by government authority to exercise censorship. Such control by government at any level,would have been more appropriate in the former Soviet Union. The Patch is not Pravda (another local media outlet is far more in the hip pocket of City government, and we do NOT need another one) and should not be subject to such control, nor should it be "encouraged" to adhere to the City's idea of "acceptable journalistic standard," as the letter states. What is news reportage but a statement of what has happened, as closely to the actual words, facts and actions as possible, not vetted by those in authority who would squelch dissenting views? Shame on you, Mr. Gonzalez.

Bee Ben I have to agree. Mr. Gonzales, if you can't stand the heat, get got of the fire! I as you all have figured out , am not a supporter of the stop the casino people. However, they have the right to make any statements in the "patch" they feel necessary to promote their position, as do I or anyone else. enough said.

Stop the Casino 101 hah a joke it tis' when are you guys going to stop hating? If you can't beat em' join em' it's time to surrender at this sad game you are hung up on don't you think? RP is actually getting a chance at being on the economic map for once in it's long life. This is great for your economy, it actually gives people a reason to come to your city now, I mean think about it.

Your lack of knowledge is, to say the least, astounding! This whole valley was indian land before it was stolen from them by the europians! If one doesn't know the history of the early Californians then it is best to keep one's mouth shut and listen to those who know whats happening. At least the 101 folks know the truth of what happened.

The Festa Italiana was last weekend. It was OK, most food booths were ripoffs. Not enough tables orRead More food choices. Hardly any cars at the car show. I really hope they do better next year. I could be a great event with more planning.
