One of the three men who was murdered during an alleged marijuana deal at a Forestville cabin last month was selling the pot to the three suspects who have been arrested and charged with the murders, according to the criminal complaint filed by the Sonoma County District Attorney's Office.
All three murder victims packaged the marijuana for transportation out of California, according to the complaint.
The Sonoma County Sheriff's Office initially said Raleigh Butler, 26, a former Sonoma County resident who recently was living in Truckee, Richard Lewin, 46, of Huntington, N.Y. and Todd Klarkowski, 42, of Boulder, Colo., were at Butler's mother's cabin to buy marijuana on Feb. 5.
Their bodies were found by Butler's brother in a bedroom at the cabin on Ross Station Road on Feb. 5. An autopsy determined they died of gunshot wounds.
In its complaint, the district attorney's office is alleging Butler was selling the marijuana to the Mark William Capello, 46, of Central City, Colo., Odin Dwyer, 38, of the Denver, Colo. area and Francis Dwyer, 65, of Truth or Consequences, N.M.
Capello and the Dwyers are charged with three homicides, burglary and conspiracy to possess marijuana for sale and sell or transport marijuana.
Capello is the only suspect who is charged with personally and intentionally discharging a .45 caliber semi-automatic firearm.
The Dwyers also are charged with being accessories who harbored, concealed or aided Capello to avoid and escape arrest, trial and conviction, according to the complaint.
Capello and Odin Dwyer are scheduled to appear in Sonoma County Superior Court Tuesday morning. They have not yet entered pleas to the charges.
Francis Dwyer had not yet been extradited to Sonoma County this morning.
According to the complaint, Capello and the Dwyers made arrangements in Colorado to obtain marijuana in California, and one of them obtained plastic bins to transport it.
The three men drove in two vehicles from Colorado to California, and Capello met Butler, Klarkowski and Lewin in Sebastopol on Feb. 4 to view a sample of the marijuana for purchase, according to the complaint.
It is alleged Capello armed himself with a .45-caliber pistol and drove with Odin Dwyer to Sebastopol on Feb. 5 to meet with Klarkowski and Lewin.
Capello and Odin Dwyer followed Klarkowski and Lewin to the cabin in Forestville to buy marijuana from Butler, and Odin Dwyer, Klarkowski, Lewin and Butler packaged the marijuana for transportation, according to the complaint.
Capello and Odin Dwyer put the packaged marijuana inside Capello's Ford Bronco for transportation, and Capello and Odin Dwyer met Francis Dwyer in Santa Rosa to discuss transferring the marijuana out of California, the complaint states.
Capello and the Dwyers then drove to Colorado and New Mexico with the pot obtained in Forestville, according to the complaint.
Capello was arrested in Mobile, Ala. after a traffic stop on Feb. 14, and the Dwyers were arrested in Colorado and New Mexico on March 1.
